Terms of Service

Please read these Terms of Service ("Terms") carefully before using Listvana (the "Service"), a Chrome Extension operated by Listvana LLC ("we", "us", or "our"). By installing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who We Are

Listvana is an independent software product designed to help Etsy sellers with listing optimisation, keyword research, revenue estimation, and shop management. We are not affiliated with, endorsed by, or certified by Etsy, Inc. in any way.

DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY LISTVANA (THE "APPLICATION DEVELOPER"). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use Listvana. By using the Service you represent that you meet these requirements.

3. The Service

Listvana is a Chrome Extension that integrates with Etsy to provide sellers with tools including but not limited to:

Revenue and sales estimation
Keyword and tag research
AI-powered listing optimisation
Competitor research and analysis
Shop health monitoring
Profit calculation

Features vary by subscription plan. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

4. Accounts and Subscriptions

Some features require a paid subscription. You agree to provide accurate billing information and to pay all applicable fees. Subscriptions are billed in advance on a monthly or annual basis. You may cancel at any time through the billing portal; cancellation takes effect at the end of your current billing period.

5. Etsy Integration

Listvana may access your Etsy shop data via the Etsy API solely to provide the services described above. You authorise us to access your Etsy account data on your behalf for this purpose. We act as a service provider to you and process Etsy data only as necessary to deliver the Service. We do not sell, license, or share your Etsy data with third parties except as described in our Privacy Policy.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of Etsy's Terms of Service or API Terms
Attempt to reverse engineer, decompile, or extract source code from the Service
Use the Service to scrape, harvest, or collect data beyond your own shop information
Resell, sublicense, or redistribute the Service or any data obtained through it
Use the Service to manipulate or artificially inflate any Etsy shop's metrics or reviews
Interfere with or disrupt the integrity or performance of the Service

7. Intellectual Property

All content, features, and functionality of Listvana - including but not limited to software, text, graphics, and logos - are owned by Listvana LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service solely for your personal business purposes.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LISTVANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Listvana LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
